1315.02 NOTICE TO THE CITY OF FORECLOSURE, FORFEITED, OR VACANT PROPERTY FILING

Any person, as described in Section 1315.01(a), who files a complaint for foreclosure or forfeiture, or vacates the property involving any real property located within the City, with or without a building or structure on the property, shall notify the City of the filing of foreclosure, forfeited, or vacany complaint or information and shall file a complete copy of the foreclosure, forfeited, or  vacancy complaint or information with the Building Official within ten (10) days after the filing of that complaint with the relevant court, or the voluntary vacancy or forfeiture. The notice to the City shall be on a form prescribed by the Building Official. (Ord. 9369-16. Passed 3-21-16).

1315.03 PERSON RESPONSIBLE FOR MAINTENANCE

(a) If the building or structure on the property that is the subject of foreclosure or forfeiture is VACANT at the time the foreclosure complaint is filed, then the person filing the foreclosure or forfeiture complaint shall notify the city of the name, address and contact information for the person who will be responsible for maintaining the property.       

(b) If the building or structure on the property that is the subject of foreclosure or forfeiture BECOMES VACANT at any time after the foreclosure or forfeiture complaint is filed, then the person who filed the foreclosure of forfeiture complaint shall notify the city of the name, address and contact information for the person who will be responsible for maintaining the property, and shall otherwise comply with this chapter.    

(c) If the property that is subject to foreclosure of forfeiture is a VACANT LOT in addition with compliance to Section 1313.02, the owner of the property shall notify the city of the name, address and contact information for the person designated as the agent in charge of the property who must be a resident of Cuyahoga County, Ohio or an abutting County who will be responsible for maintenance and financial obligations of the property, accept service on behalf of the owner and who shall otherwise comply with this chapter. 1315.04 FEES

(a) The fee for notice of a foreclosed, forfeited, or vacant property is two hundred and fifty dollars ($250). The fee shall be paid at the time  of notification.  

(b) Any person, as defined in Section 1315.01(a), who fails to file a complaint of foreclosure, forfeited, or vacancy form with the Building Official within ten days as required in Section 1315.02 shall be charged a late filing fee in the amount of seven hundred fifty dollars ($750). Notification of FORECLOSED FORFEITED VACANT PROPERTIES


Building Codes affect each of us every day of our lives—whether in our homes, offices, schools, stores, factories or places of entertainment. We rely on the safety of structures that surround us in our everyday living. The public need for protection from disaster due to fire, structural collapse and general deterioration underscores the need for modern codes and their administration. Today’s building department also enforces laws that help protect its citizens from unscrupulous contractors while maintaining property values through property maintenance programs.

The City of Bedford, Division of Building is managed under the general supervision and direction of the City Manager’s Office. The Division is responsible for the enforcement of Building, Housing and Zoning codes as well as other ordinances adopted by City Council and set forth in the Building Code, Chapters 1301 through 1399, and the Zoning Code, Chapter 1901 through 1999. For all residential structures, the Building Department enforces the Bedford Dwelling House Code. This code includes the 2013 edition of the code entitled The Residential Code of Ohio with updates, plus the 2014 edition of the National Electrical Code and the 2011 edition of the Ohio Plumbing Code. It also includes the 2012 edition of the International Property Maintenance Code. For commercial (non-residential) buildings, as a State of Ohio-Certified Building Department, Bedford enforces the 2011 edition of the Ohio Building Code with updates, including the 2014 edition of the National Electrical Code, and the 2011 editions of the Ohio Plumbing Code, and Ohio Mechanical Code.
